Terms & Conditions
This page outlines OUR policies and expectations
for those who are interested in finding
out more about us before ordering.
1-When you add a frangipani tree to your cart and
checkout on the www.FrangipaniTrees.com website,
you understand that your purchase has not been
finalized.
1a-Online purchases need to be confirmed by email or
phone. After we have confirmed your order, you can
proceed to make your payment by direct deposit, bank transfer
or paypal. If you are in South East Queensland and
we will be doing your delivery, you can arrange to
pay cash on delivery.
1b-Please request an official invoice if you require
one and do not
receive it. This invoice will have
our ABN and GST details on it. Any automated emails from the Ecommerce system
detailing orders can be used as a quotation but are
not an official tax invoice.
2-When making
payment for an order, you understand that any
proposed delivery date may be delayed due to
unforeseen circumstances.
2a-Where possible, we keep all customers informed as
to when we hope to ship their order and to any
possible delays.
2b-Factors such as
oversized trees, out of the way locations and off
season orders can increase the time it takes between
making your order and us getting your ordered
frangipani trees to you.
2c-If you make your deadline clear to us when
ordering and we are
unable to arrange delivery by that time, we will
offer you a full refund.
3-It is our policy
that if a customer cancels 5 days or more
before any proposed delivery date, we will refund
payments in full.
3a-Requests to cancel orders within 5 days of the
proposed delivery date will usually result in the
loss a $50 deposit.
3b-Any cancellation after delivery has been
initiated (including a return) will result in the
customer being required to cover all
transportation costs and a $50 handling fee.
4-We arrange
delivery on the customers behalf.
4a-The transport companies which we usually use handle
only plants and handle plants
everyday. It is essential for the survival of their
business to take care of the goods they transport.
The drivers load and unload plants everyday so most
have become very skilled at it.
4b-Frangipani branches are quite flexible and can
often endure being squeezed in amongst other plants.
They can endure long hot trips and long periods
without water. Unlike electronic goods, frangipanis
will always go on working in the future no matter
how roughly they are treated during transportation.
4c-On the rare occasion, damage to our frangipanis
has occurred during interstate transportation. This
is invariably a broken off branch.
Frangipani branches can be flexible but when bent
too far, they can completely snap off. You can
easily notice if a branch has been broken during
transportation because there will be fresh white sap
on the break. The factors which possibly contribute
to damage during transportation are;-
(i) us making a frangipani available for interstate
sale which is not suitable for interstate
transportation.
(ii) the transport company not using enough care.
(iii) the customer agreeing to transport a
frangipani order which extends beyond the purchased
space.
(iv) Bad luck. The truck can hit a pothole on a NSW
highway causing another item to fall onto the
frangipani tree.
4d-If your frangipani happens to arrive with a
broken off branch, please ask them for the broken
branch. Just because a branch is broken off, it
doesn't mean they don't have to deliver it, right?
Also, if you're asked to sign "received in good
order" just write "damaged" in the box. These two
actions may help the driver, management and the
company as a whole to realize that a broken
frangipani branch is no flippant matter. We will
also pass on any photos or emails about damage
during transportation.
4e-Feel free to send us a photo of the damage or
broken branch and ask us if it possible to get
compensated for the damage. Even though the
transport company may have caused the damage and may
not take responsibility, we would like to show our
regret by reducing the amount paid for the
frangipani to better reflect it's reduced value.
We do not expect this gesture to take away all of
the disappointment, but we'd prefer to do this
rather than deny all responsibility.
4f-We will assist customers as much as we can who
wish to choose their own transport company or pick
up their ordered frangipani trees personally.
5-Unless you notify
us of your concern within the first few days after
receiving your order, you accept that any
reduction of health or death is the result of
the new environment, not the condition of the
frangipani tree at the time of delivery.
5a-We recommend you read out
frangipani advice
page before receiving your frangipani order which
will equip you with all the necessary knowledge to
transplant and take care of your newly purchased
frangipani tree(s).
5b-Inspect your frangipani tree as soon as you
receive it. If you are concerned about something,
let us know by email. State your concern and ask us
how we feel about it. If it develops into a bigger
problem later, you can send us another email with a
photo. With this evidence, we will be able to take
responsibility and organize a replacement frangipani
for you.
6-When you order a
frangipani tree from www.FrangipaniTrees.com, you
accept that the photo(s) may not depict all
of the qualities of the tree and due to the
passing of time and seasonal factors, may not depict
its present appearance.
6a-When time permits, descriptions of easily
noticeable imperfections and photos from different
angles will be included. Alternatively, comments
like "almost flawless" will be included in the
description where appropriate.
7-When you order a
frangipani tree from us, you accept that the
information presented on
www.FrangipaniTrees.com
is to assist in the process of selection and
figures are approximations. Only figures
inaccurate by more than 20% will be considered
inaccurate.
7b-When you order a frangipani tree from us, it
assumed you have read the accompanying
description and you are aware of the
imperfections (if any) which are stated in the
description.
